Terms of Service

1. Overview

Setup My Dream is a U.S.-based web development agency specializing in $0 upfront website builds and affordable monthly maintenance plans. We provide professional website creation, hosting, branding, SEO, and optional AI solutions for local and online businesses nationwide.

2. Core Offer

$0 Upfront Website Build

Includes a custom-designed 4-page website, built using React, Next.js, and Tailwind CSS.

The free build covers initial design, responsive layout, basic SEO setup, and content integration.

Additional pages or advanced features may incur one-time or monthly costs as outlined in your proposal.

Hosting & Care Plan – $99/month

The Hosting & Care Plan covers:

• Secure hosting with Cloudflare Pages CDN
• Automatic SSL certificates
• Weekly backups with 30-day retention
• Security and performance monitoring
• Core updates and dependency patching
• Uptime monitoring and incident response
• 30 minutes of content updates per month
• Email support and quarterly performance reviews

3-Month Minimum Commitment: A minimum of 3 months of Hosting & Care Plan service is required after launch. After that, you may cancel anytime with 30 days' notice.

4. Payment Terms

Website build is $0 upfront.

Hosting & Care Plan is billed monthly at $99 USD.

All services require a valid payment method on file.

Late or declined payments may result in service suspension.

5. Refund Policy

We offer a 30-day refund policy on your first month of Hosting & Care Plan service.

Refunds exclude any third-party pass-through costs (domains, ads, paid plugins, or integrations).

After the 30-day period, all fees are non-refundable.

6. Ownership & Access

Clients retain full ownership of their website content, design, and domain once the minimum 3-month commitment is fulfilled.

We provide access to your GitHub repository or code export upon request.

Third-party assets (fonts, stock photos, or software) remain under their respective licenses.

7. Domain & Email

Setup My Dream includes one standard domain (.com, .org, or .net) for the first year.

Premium or specialty domains may cost extra.

You may transfer your domain at any time after the initial 3-month term.

8. AI Features and Automation Disclaimer

AI Add-On services are experimental pilot programs.

While we aim for high accuracy, Setup My Dream does not guarantee 100% correctness in AI-generated responses, scheduling, or content output.

Clients are responsible for reviewing and approving all AI-generated materials before publishing.

9. Service Availability and Maintenance

Temporary downtime may occur during updates or maintenance.

We prioritize uptime and performance but cannot guarantee 100% availability.

We use leading-edge hosting through Cloudflare Pages and Next.js Edge Functions for speed and scalability.

10. Cancellation Policy

You may cancel after the initial 3-month term with 30 days' written notice.

Cancellation stops all hosting, backups, and active monitoring at the end of your paid period.

A website export or migration request must be submitted before cancellation if you wish to self-host.

11. Limitation of Liability

Setup My Dream is not responsible for:

• Loss of profits, data, or opportunities resulting from downtime or misuse.
• Errors caused by third-party platforms (e.g., Google, Meta, domain registrars, or hosting providers).
• Any indirect or consequential damages beyond the total amount paid for services in the last 3 months.

12. Compliance & Data

We follow general best practices for privacy, cookies, and accessibility.

Clients are responsible for their own business's legal and compliance obligations (e.g., ADA, HIPAA, GDPR).

Setup My Dream does not collect or sell user data beyond analytics necessary for service delivery.

13. Portfolio and Attribution

Unless otherwise requested in writing, Setup My Dream may showcase completed projects in our portfolio (screenshots, domain name, or logo) to demonstrate design and technical capabilities.

14. Updates to These Terms

We may update these Terms periodically.

Any changes will be posted at https://www.setupmydream.com/terms with the updated date.

Continued use of our services after an update constitutes acceptance of the new Terms.
